1. Acceptance of Terms

By accessing or using Masko ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms are governed by French law.

2. Description of Service

Masko is an AI-powered mascot generation platform that allows users to create mascot images and animations for their applications and brands.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate information
  • Be at least 18 years old or have parental consent
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Credits and Payments

The Service operates on a credit-based system:

  • Credits can be purchased through subscription plans
  • Payments are processed securely via Stripe
  • All prices are displayed in Euros and include applicable taxes
  • Subscriptions automatically renew unless cancelled

Refunds: You may request a refund within 14 days of purchase if you have not used the purchased credits, in accordance with French consumer law.

5. Intellectual Property Rights

Generated Content Ownership

To the fullest extent permitted by applicable law, you own all rights to the mascots, images, and animations you generate through the Service. This ownership is immediate, complete, and includes all commercial rights without restriction.

Your Rights

  • Use generated mascots in your products, apps, and marketing
  • Modify and adapt the generated content freely
  • Sell products featuring your generated mascots
  • Register trademarks using your generated content
  • No attribution required

Your Responsibilities

You represent that you have the rights to any content you upload and that your use of the Service does not infringe third-party intellectual property rights, including copyrights, trademarks, or publicity rights.

Non-Uniqueness of Outputs

Due to the nature of generative AI, the Service may produce similar or identical outputs for different users based on similar inputs. Masko does not guarantee the uniqueness of generated content.

Limited License to Masko

You grant Masko a limited, non-exclusive license to use your generated content solely to:

  • Operate, maintain, and secure the Service (hosting, delivery, caching)
  • Display content in your account and collections
  • Provide customer support and troubleshoot issues
  • Comply with legal obligations

We will not use your generated content for promotional purposes or display it publicly without your explicit consent.

Service Improvement

We may use anonymized, aggregated data to improve our services and enhance the quality of generated content.

Showcase & Gallery

With your explicit permission, we may feature your mascots in our gallery or marketing materials.

6. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or offensive content
  • Infringe on third-party intellectual property rights
  • Attempt to reverse-engineer or exploit the Service
  • Overload or disrupt the Service infrastructure
  • Share account credentials with unauthorized users
  • Circumvent usage limits or credit systems

Violation of these terms may result in immediate account termination.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will notify users of planned maintenance when possible.

8. Limitation of Liability

To the maximum extent permitted by French law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not responsible for third-party services or integrations

These limitations do not affect your statutory rights as a consumer under French law.

9. Termination

By You: You may cancel your account at any time from your account settings. Unused credits from paid plans are non-refundable after the 14-day withdrawal period.

By Us: We may suspend or terminate your account for violation of these terms, with notice where possible. In case of serious violations, termination may be immediate.

10. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

11. Governing Law and Disputes

These terms are governed by French law. Any disputes shall be submitted to the competent courts of France.
